Communist Party of Nepal (CPN), the name CPN-UML and CPN (Maoist Center) have chosen for the unified party, has already been registered at the Election Commission.
CPN led by Rishi Ram Kattel had participated in the November 26 and December 7 elections to the House of Representatives and Provincial Assemblies with the election symbol , hammer and spade.
According to officer at the legal section of the EC Gham Chandra Timsina, CPN was registered in 1992.
Netra Bikram Chand also calls his party CPN. Chand, however, has not registered its name in the EC.
Meanwhile, CPN was also registered on August 26, 2017 when the EC had invited parties for registration to participate in the House of Representatives election.
The Election Commission will not register a new party with the same name when another party has already been registered. With this, the left alliance has to pick another party name.
CPN had also registered at the EC to participate in the local level election of May 14, 2017. During that time, the EC had also published the list of parties enlisting CPN in the 39th number.
Article 6.1 (e) of the Act related to Political Parties mentions that any party's name or the party's symbol would not be registered if it was found already registered at the EC.
Earlier, the party formed after unification of six Madhes-based parties was refused registration as Rastriya Janata Party by the EC. Later, the party had to add 'Nepal' at the end of its name.
UML and Maoist Center after the unification coordination committee meeting held at Prime Minister's official residence in Baluwatar Monday night, signed an agreement on unification that mentions the unified party will be called CPN. Both the chairmen of parties and six others also signed the seven-point agreement. The new ideology of the unified party will be based on Marxism-Leninism.
