The Supreme Court (SC) on Friday has approved the application filed by the newly-appointed Chief Executive Officer (CEO) of National Reconstruction Authority (NRA) Sushil Gyawali to withdraw the writ petition filed against the Pushpa Kamal Dahal government which dismissed him. He had applied for withdrawal of the petition just before assuming office on Thursday.
A joint bench of acting Chief Justice Om Prakash Mishra and Justice Bam Bahadur Shrestha has granted withdrawal of the petition, according to the SC.
The Cabinet meeting Tuesday night had reappointed Gyawali, who was sacked from the post by the then Pushpa Kamal Dahal government almost two years ago, as the CEO of NRA.
The Dahal government had sacked Gyawali in February 2017 stating that he could not furnish satisfactory explanations in two attempts. Gyawali had moved the SC against the decision.
The government had then appointed Govinda Raj Pokharel who had preceded Gyawali. Pokharel resigned to contest the general elections last year.
Former secretary Yuba Raj Bhusal was appointed CEO after that. But the post was vacant after the KP Sharma Oli government took a decision to annul all the appointments made by the preceding Sher Bahadur Deuba government after the election code of conduct came into effect.
