The Judicial Council has dismissed district judge Bishwa Mangal Atreya.
The council following a meeting on Tuesday has also decided to lodge a court case against Omkar Upadhyaya who had resigned from district judge after the council recommended action against him, according to communication officer at the council Tek Nath Gautam.
Atreya was brought to the council from the Mustang District Court following a complaint against him. Atreya was accused of giving a clean chit to promoters of different manpower companies who arranged visas for workers going abroad while he was serving in Lalitpur.
The council has also decided to seek clarification from judge at the Kathmandu District Court Babu Kaji Baniya within a week asking him why the council should not take action against him. Nayab Subba (first class non-gazetted officer) Bhola Nath Chalise, who was arrested by the Commission for Investigation of Abuse of Authority (CIAA) while taking a bribe of Rs 500,000, had claimed he had taken the bribe in consultation with Baniya.
A probe committee including Judicial Council members Ram Prasad Sitaula and Padam Vaidik was formed to investigate complaints against Upadhyaya . The committee had recommended action against him and the recommendation had been published in the Nepal Gazette by the council.
The council stated that he had submitted only provisional certificate saying he completed bachelor's from Kanpur University (Chhatrapati Shahuji Maharaj University now) of India. But only original transcripts are accepted.
The committee's investigation also showed that Upadhyaya released Mansur Khan on bail instead of sending Khan to judicial custody on a case about fake citizenship when he was district judge in Parsa despite the law requiring those involved in such charges being kept in custody for investigation.
There were complaints against him accusing him of irregularities in verdicts, and becoming judge on the basis of fake certificates. He was summoned to the council 10 months back after complaints were lodged against him while he was in Tanahu District Court.
