Attorney General Basanta Ram Bhandari has said he will take decision himself if the public prosecutors do not file a forgery case against former Nepal Police DIG Nava Raj Silwal as recommended by the police.
Claiming that the government attorneys have been threatened to not register the case, Bhandari told Setopati he will take the decision himself if they do not.
The police have submitted a report, including recommendation for filing a case, to the District Attorney Office, Kathmandu claiming that Silwal, who was elected to the House of Representatives (HoR) from Lalitpur-1 on CPN-UML ticket, has forged the file of performance evaluation that needs to be kept secret.
The police report is currently in the District Attorney Office. Chief district attorney of Kathmandu Surya Raj Dahal told Setopati that he will take decision after studying the police report.
Attorney General Bhandari claimed that the public prosecutors have been threatened and opined that Silwal must be tried for forgery. "This issue has already been politicized. The District Attorney Office is being threatened. Different parties have threatened. I must do something if the District Attorney Office cannot do anything in such situation. There was a way for Silwal to get a clean chit on the basis of his statement if the forgery charge were investigated," Dahal elaborated.
He stated that those personible for forgery of performance evaluation file have to be punished even to implement the Supreme Court's (SC) order. "The SC has ordered to take action against forgery. There is a forensic report that says there has been a clear forgery. It was assumed that the person who submitted it must have forged. He should have given a statement if he did not forge. The SC's order cannot be ignored. The police have done their bit and submitted the report to the District Attorney Office. I will take decision if the District Attorney Office does not register the case or says it is facing difficulty in taking decision," he explained.
The police had initiated investigation against Silwal after the performance evaluation file, that should be kept secret, was deemed to have been forged.
Silwal has been absconding after the investigation started.
